Terms & Conditions
Please read these terms carefully before entering the competition. Entering the competition constitutes an acceptance of these terms and conditions.

Who can enter
● The Competition is open to any resident of the United Kingdom over 18 years of age.
● The Competition is closed to employees of Hannah Martin Flowers and Scent + Remedy and their close relatives and anyone otherwise connected with the organisation or judging of the Competition.
● Automated or bulk entries from third parties will be disqualified.
● We reserve the right to exclude serial competition entrants who have entered more than 4 competitions in the last month.
● There is no entry fee and no purchase necessary to enter this competition.
Dates of competition
The Competition opens (9PM GMT 16/05/2022 ) and closes (5PM GMT 30/05/2022) Entrants can enter at any point between these dates.

How will the winner be selected and announced
● The winner will be selected at random from the list of entrants by Hannah Martin Flowers using an on-line random number generator such as https://www.calculator.net/random-number-generator.html.
The winner will be notified via DM on Instagram within 14 Days of the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

● The Prizes are as stated and they cannot be sold or exchanged for cash, goods or services. Unless specifically agreed in writing by Hannah Martin Flowers

Marketing promotions
● Hannah Martin Flowers reserves the right to use the voice, image, photograph, name and likeness of the winners for publicity and in advertising, marketing or promotional material without additional compensation or prior notice to the winners. In entering the Competition, all participants consent to such use of their voice, image, photograph, name and likeness.
● Copyright of any material produced as part of the competition is owned by Hannah Martin Flowers and/or its content suppliers.
● Unauthorised use of the material produced as part of this competition, including reproduction, storage, modification, distribution or publication without the prior written consent of Hannah Martin Flowers or, where applicable, the respective competition entrant is prohibited.
● Where you are able to submit any contribution to this competition you agree, by submitting your contribution, to grant Hannah Martin Flowers a perpetual, royalty-free, non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution. If you do not want to grant the rights set out above, please do not submit your contribution to Hannah Martin Flowers.
By submitting your contribution to Hannah Martin Flowers you warrant that your contribution is your own original work and that you have the right to make it available to Hannah Martin Flowers for any or all of the purposes specified above. Furthermore, you warrant your contribution is not defamatory, does not infringe any law, you indemnify Hannah Martin Flowers against all legal fees, damages and other expenses that may be incurred by Hannah Martin Flowers as a result of your breach of the above warranty and waive any moral rights in your contribution for the purposes of its submission to and publication on the Site and the purposes specified above.
Data protection
● You consent to your first name, photograph and social media handles about you being disclosed on Hannah Martin Flowers digital channels or other media if you win any Prizes under the Competition
● Any personal data relating to participants will be used solely in accordance with UK data regulations and will not be disclosed to a third party without the entrant’s prior consent.
● By entering the Competition, you agree that Hannah Martin Flowers may contact you in relation to the Competition.
Absolving responsibility of the social platforms
● This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or any other social network.
General liability cover
● Hannah Martin Flowers do not accept liability for any damages whatsoever, including, without limitation, indirect or consequential damages, loss of profits, or any damages whatsoever arising out of, or in connection with the competition.
● Except in the case of death or personal injury arising from its negligence, or in respect of fraud, and so far as is permitted by law, Hannah Martin Flowers and its associated companies and agents and distributors exclude responsibility and all liabilities, whether direct or indirect, arising from:
● any postponement or cancellation of the Competition;
● any changes to, supply of or use of the Prize; and
● any act or default of any supplier, which are beyond Hannah Martin Flowers reasonable control.
● Hannah Martin Flowers does not accept responsibility for any liability arising from technical incompatibility, problems relating to the internet, or technical difficulties of any kind and no responsibility can be accepted for entries not received for whatever reason.
● Hannah Martin Flowers shall not be liable, whether in tort, contract, misrepresentation or otherwise for loss of profits, loss of anticipated savings, loss of goods, loss of use, loss or corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses
● You agree to indemnify Hannah Martin Flowers against all liabilities, claims and expenses that may arise from any breach of your agreement with Hannah Martin Flowers.
● We reserve the right to change the Competition rules and these Terms and Conditions from time to time. If we do so, we will always have the most up to date terms and conditions on the Website and in the case of a discrepancy between these terms and conditions and those on the Website, the Website terms and conditions will apply.
● These Terms and Conditions shall be governed and construed in accordance with the laws of England and Wales. Any disputes arising here shall be exclusively subject to the jurisdiction of the courts of England and Wales.
PRODUCTS
1.1 Certain products may be delivered by us in bud to ensure a longer vase life. This will not be the case for any wedding products which will be in full bloom and at their best for the day in which their ordered for.
1.2 Some plants and flowers may be harmful or poisonous, should not be eaten and are for decoration only. Should you require further clarification on any specific product please contact us in writing to hannah@hannahmartin.net.
1.3 All products are subject to availability and in the event of any supply difficulties or sub standard product from our wholesaler we reserve the right to substitute for an alternative product or equivalent value and quality without giving notice.
1.4 In the event that we cannot fulfil an order at all, we shall notify you as soon as is reasonably possible and shall reimburse your payment in full and in any event no later than 30 days after the intended delivery date.
PRICES
2.1 All prices listed on the website or in a written quote are valid for 14 days from submitting your order or sending your proposal. Thereafter they may be subject to change unless otherwise stated.
ORDERS & PAYMENTS
3.1 During order submission you shall be required to provide us with your personal details, including full postcode, together with those of the intended recipient and all the necessary payment details. Once an order has been placed you are agreeing to our Terms & Conditions as laid out in this document and appearing on our website. By viewing our website or placing an order you are agreeing to our Terms & Conditions.
3.2 We cannot accept orders from persons under the age of 18 (eighteen) years.
3.3 Your order is not live until it has been accepted and agreed by us (Hannah Martin Flowers) in writing.
3.4 Payments may be made in cash or bank transfer.
DELIVERY
4.1 All deliveries are subject to agreement by Hannah Martin Flowers. In the event of us not being able to deliver to your location we may offer an overnight courier service or send by Royal Mail packed in suitable flower boxes to ensure your flowers arrive in top condition. We cannot deliver by post/courier on Sundays or Mondays.
4.2 Anomalies in your submitted personal details may lead to problems or delays in delivery, so please ensure that you provide full and accurate details for delivery including full address and postcode, a contact number where possible and the name of the recipient as well as their contact number if possible. Should there be a delay to your delivery we will notify you of any delays as soon as possible so you should provide a daytime contact number and email address where you will be available.
4.3 It is your responsibility to ensure that the person or persons in receipt of flowers are available at the address provided on the agreed delivery date. Where no-one is available we will try to leave with a neighbour and leave a calling card in the intended recipients door to contact us. You may be subject to a re-delivery fee depending on the delivery area. Free re-delivery is subject to Hannah Martin Flowers' discretion.
4.4 Where deliveries are delivered to a third party ie offices, hospitals, hotels etc the signature of any person authorised to accept deliveries on behalf of the organisation shall be deemed as accepted proof of delivery. We cannot be held responsible if that person then fails to deliver to the correct person.
4.5 Whilst we agree to ensure delivery on the agreed delivery date we cannot guarantee a specific time and on occasion where circumstances are out of our control and we cannot deliver we will contact you as soon as possible to re-arrange another deliver date or we will reimburse you in full.
4.6 Where goods have been correctly delivered to a specified address we cannot be held responsible if the intended recipient has moved or lives elsewhere and the actual recipient refuses or fails to return goods to us.
4.7 It is possible to request a specific delivery slot for Funerals, Weddings and specific functions. Where a delivery time is required you should place your order at least five working days before the required date. All correct information with regards to delivery address and contact numbers MUST be given at the time of placing your order.
4.8 In the instance of the recipient not being available we reserve the right to contact the intended recipient via the details supplied by you at the time of placing your order.
CANCELLATION
5.1 You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit cards by another person not acting on behalf of you.
5.2 You may cancel an order placed, no less than 14 working days before deliver due date unless otherwise agreed by Hannah Martin Flowers.*
5.3 *In the case of a Wedding you may cancel no less than six weeks before the wedding due date. Cancellations after this time will be charged in full (minus delivery/set up charges and at the discretion of Hannah Martin Flowers). Weddings cancelled 1 (one) to 3 (three) months before the wedding will be subject to 75% of the final fee and 3 (three) to 6 (six) months 50% of the total. Any goods hired/costs incurred in respect of your wedding will be subject to hire fees if Hannah Martin Flowers has incurred costs on your behalf regardless of when your wedding is cancelled. This includes props purchased/hired specifically for your event where Hannah Martin Flowers cannot recoup costs. All booking fees are non returnable (but may be returned at the discretion of Hannah Martin Flowers). By submitting your booking fee/payment you are agreeing to these Terms & Conditions. Postponing your date will also be deemed as a cancellation unless agreed by both parties.
CUSTOMER SERVICE
6.1 In the event that you are not satisfied with our service then any complaints should be made in writing to Hannah Martin Flowers. You may contact us via the website for full address details.
6.2 Because of the perishable nature of the products and in order for us to resolve any complaints you may have, we advise you to contact us within 1 (one) working day of the date of the delivery or intended delivery of your purchase. In any case all complaints on perishable products must be reported to us within 3 (three) working days maximum.
GENERAL
7.1 We reserve the right to supplement and amend the Terms & Conditions on which you are permitted to access online from time to time. Should any changes to Terms & Conditions be made we will post these online. It is your responsibility as the customer to view the Terms & Conditions each time you place an order and all amendments will be effective 5 (five) hours after posting to our website.
7.2 We reserve the right to change/suspend/restrict any offers online.
7.3 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under the Terms & Conditions unless otherwise agreed between us (Hannah Martin Flowers) and You (the client).
7.4 Your purchase will be deemed to have occurred in the UK. These Terms & Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.
ADDITIONAL (WEDDINGS/EVENTS)
8.1 All weddings require a non returnable booking fee of 20% to save the date of your wedding and make the agreement firm.
8.2 Full and final payment is required fourteen days before the actual date of the wedding. Failure to make full and final payment may result in a delay to your flowers and/or non delivery. If payment has not been paid 14 days before the date of your event we reserve the right to cancel the agreement between us (Hannah Martin Flowers) and you (The Client)
8.3 In the case of equipment hire ie. Vases, containers etc a returnable deposit is required unless otherwise agreed by Hannah Martin Flowers. In the case of no deposit being given you will be liable to pay for any breakages that may occur during the date of you Wedding or Event.
8.4 We accept no liability for any harm, damage, loss of property, personal injury as a direct result of you or a third parties negligence.
8.5 We reserve the right to replace or supplement any flowers agreed with a similar flower to the same or higher value should, due to unforeseen circumstances the agreed flower becomes unavailable due to circumstances out of our control.
8.6 We will only be able to hold your date for 21 days from receipt of your quote or until a booking fee has been paid. Thereafter we reserve the right to offer dates to other clients and are not bound to accept jobs after this time. It is strongly advised that a booking fee is paid to reserve your date to avoid disappointment.
8.7 Quotes / requirements may be amended up to two weeks before the date of the event but may be subject to a minimum spend and may not be reduced by more than 10% unless agreed by Hannah Martin Flowers from the original agreed quote. Any major changes to your flowers will be at the discretion of Hannah Martin Flowers and any late changes cannot be guaranteed less than 8 weeks before the date of your event. We strongly advise all details are confirmed before this time to ensure delivery of your flowers and in order for us to fulfil the agreed quote.
8.8 All flowers will be cleared from your wedding venue at a time agreed between Hannah Martin Flowers and the Venue after the event. Any flowers left by the wedding party will be cleared and disposed of unless otherwise agreed between you, The Client and Hannah Martin Flowers and/or the Venue. Any equipment that has been loaned/hired by the You, The Client must be left for collection otherwise all missing, broken equipment will be charged for by Hannah Martin Flowers.
8.9 Weddings are subject to a minimum spend during peak periods (May to October) and once an initial quote has been agree should not be reduce by more than 10% (unless agreed by Hannah Martin Flowers). The minimum spend during this time is £1500, unless agreed by Hannah Martin Flowers.
9.0 In the case of extreme weather conditions we cannot be held responsible for non delivery, late delivery or damage to flowers either due to extreme heat (29 degrees or more) or adverse cold weather (snow). We will endeavour to deliver on time and you will be notified of any late delivery as soon as is possible.
COVID-19
9.1 We (Hannah Martin Flowers) will endeavour to reschedule any postponed wedding or event on the occasion that Venues close or the Government advise to postpone weddings or events.
9.2 The Terms & Conditions set out in this document will still stand should any wedding or event be postponed due to Covid-19.
9.3 Any changes (for example the number of guests, or changes to Personal Flowers) to the order for wedding or event flowers due to Covid-19 will be made as agreed by Hannah Martin Flowers and You (The Client).
9.4 The prices within the original agreed quote will remain the same.
9.5 Should any flowers or foliage be out of season on the revised wedding date, Hannah Martin Flowers will advise a suitable alternative.
